Mike Frassinelli of Hedge Fund Alert interviewed GAP Managing Partner Roseanne Harford about the SEC’s expected rulemaking agenda to increase transparency of swap holdings and impose antifraud liability on the daily activities of swap counterparties. Roseanne predicted the SEC would take its time to be sure that it had addressed the extensive, largely negative feedback on proposed Rules 9j-1 and 10B-1 before moving ahead with final rules. She highlighted the pressure that the Supreme Court’s decision in West Virginia v. EPA is likely placing on SEC policy makers to be sure that they link their rules clearly to the authorizing legislation and carefully address all of the requirements of the Administrative Procedure Act.
